By accessing or using The Logistic Manager application ("the App"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, you must not use the App. These terms apply to all users including administrators and staff members.

The Logistic Manager is a real-time logistics and job management platform designed for removalist and transportation businesses. The App provides tools for job tracking, staff management, GPS monitoring, break tracking, emergency reporting, and internal communication.

Access to the App is granted by an administrator. You are responsible for maintaining the confidentiality of your login credentials. You must notify your administrator immediately if you suspect unauthorised access to your account. Each account is for a single named individual and must not be shared.

The App collects GPS location data during active jobs and staff breaks for operational purposes. This data is visible to administrators and designated staff with appropriate permissions. By using the App, you consent to the collection and use of your location data as described. Location data is used solely for job coordination and safety purposes and is not shared with third parties.

When a staff member activates a break, the App may silently record GPS location data for the duration of the break. This data is accessible to administrators for operational and safety purposes. Staff members acknowledge this monitoring as a condition of using the break tracking feature.

Photos uploaded through the App (e.g. job step photos, emergency reports) are stored securely and are accessible to authorised users within your organisation. You must only upload photos relevant to legitimate work activities. Do not upload inappropriate, illegal, or irrelevant content.

The emergency reporting feature is for genuine work-related emergencies (vehicle breakdown, accident, truck damage). Misuse of the emergency system may result in account suspension. All emergency reports are logged and visible to administrators.

We are committed to protecting your personal information. Data collected through the App is used exclusively for the operation of the logistics management service. We do not sell, trade, or share personal data with third parties except where required by law. Data is retained for operational purposes and may be reviewed by authorised administrators.

You agree to use the App solely for its intended business purposes. You must not attempt to hack, reverse engineer, or disrupt the App's services. You must not use the App to send inappropriate communications to colleagues. Misuse of any feature may result in immediate account termination.

Access to full features requires a valid annual subscription of $899 AUD (incl. GST of $81.73) as outlined in the pricing section. Subscriptions are valid for 365 days from the date of payment. Renewal is strictly manual — there are no automatic charges, recurring billing, or stored payment details. You will be notified within the app in advance when your renewal is approaching. If payment is not made before the expiry date, account access will be restricted until the administrator manually completes payment through the renewal page. All payments are processed securely via PayPal. Refunds are available within 30 days of payment where not satisfied. The App may modify pricing with reasonable notice to existing subscribers.

All content, branding, features, and functionality of The Logistic Manager are the exclusive property of the platform and are protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without express written consent.

The Logistic Manager is provided "as is" without warranties of any kind. We are not liable for any indirect, incidental, or consequential damages arising from your use of the App, including but not limited to data loss, service interruptions, or GPS inaccuracies. Our total liability shall not exceed the amount you paid for the service in the prior 12 months.

We reserve the right to update these Terms and Conditions at any time. Continued use of the App after changes constitutes your acceptance of the new terms. We will endeavour to notify administrators of significant changes via the App.

Drive Mode is a feature that enables real-time GPS tracking, speed monitoring, and route logging while a staff member is operating a vehicle in the course of their employment duties. By enabling Drive Mode, you agree to the following conditions:

Distraction Laws: Under Australian Road Rules (Road Safety Act and corresponding state/territory legislation), using a handheld mobile device while driving is illegal in all states and territories. Staff must only activate or deactivate Drive Mode while the vehicle is stationary, safely parked, and the engine is off or the handbrake is engaged. It is the responsibility of the driver to comply with the mobile phone use laws applicable in their state or territory.

Heavy Vehicle Law: Drivers operating heavy vehicles (over 4.5 tonnes GVM) must comply with the Heavy Vehicle National Law (HVNL) and the Chain of Responsibility (CoR) provisions. This includes mandatory rest breaks and compliance with fatigue management obligations under the NHVR (National Heavy Vehicle Regulator). The App's break tracking feature is intended to assist with but does not replace legally required fatigue records.

Speed Monitoring: Drive Mode may record and display vehicle speed via GPS. Drivers are required to comply with all posted speed limits and road rules regardless of what is displayed in the App. GPS speed readings may not reflect instantaneous speed with absolute accuracy and should not be relied upon as a substitute for the vehicle's speedometer.

Employer CoR Obligations: Under the Chain of Responsibility (CoR) provisions of the HVNL, administrators and employers using this platform have obligations not to cause, pressure, or incentivise drivers to breach road safety laws (including speeding, fatigue, or distracted driving). Using Drive Mode data to compel unsafe driving behaviour is prohibited and may constitute a criminal offence under Australian law.

Fatigue Management: Drivers of commercial vehicles are subject to fatigue management requirements. Standard hours allow a maximum of 12 hours driving in a 24-hour period with mandatory rest breaks. The App does not automatically enforce fatigue compliance and drivers are solely responsible for managing their own fatigue obligations in accordance with NHVR standards.

Dashcam and Privacy: If integrated dashcam or audio/video recording features are used in conjunction with Drive Mode, all recordings must comply with applicable state surveillance and privacy legislation. Covert recording of passengers without consent may be unlawful.

Data Retention: Drive Mode GPS and speed data may be retained by the administrator for operational, safety audit, and Chain of Responsibility compliance purposes. Staff are notified that this data forms part of their employment record during driving shifts.

Your access may be terminated by your administrator at any time, or by us if you breach these terms. Upon termination, your access to the App and associated data will be revoked. Administrators may request data export prior to termination.

These Terms and Conditions are governed by the laws of Australia. Any disputes arising from the use of the App shall be subject to the exclusive jurisdiction of the Australian courts.
